Agreement to Terms

Welcome to Prime Photo. These Terms of Use govern your access to and use of Prime Photo, including the mobile app, website, AI photo generation features, Explore templates, subscriptions, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these terms and to comply with applicable app store rules. If you do not agree, do not use the Service.

If you download or use the Prime Photo app from the Apple App Store, these terms also serve as the end user license agreement (EULA) between you and Prime Photo for the app. These terms are concluded between you and Prime Photo only, and not with Apple; Prime Photo, not Apple, is solely responsible for the app and its content. You acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these terms and, upon your acceptance of these terms, will have the right to enforce these terms against you as a third-party beneficiary. If any provision of these terms conflicts with Apple’s Licensed Application End User License Agreement, these terms govern except where the Apple terms are required to control.

Service Overview

Prime Photo is a photo generation application that lets you upload your own photos, select or write prompts, provide optional appearance settings, and create AI-enhanced images in various poses and settings while maintaining your likeness for personal purposes. You are responsible for the photos, prompts, settings, and other content you submit, and you must have all rights and permissions needed to use that content with the Service.

If you obtained the app from the Apple App Store, the license granted to you is a limited, non-transferable license to use the app on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

Age Requirements

You must be at least 18 years old to use Prime Photo. If you are under 18, you may not create an account, upload photos, submit prompts, purchase subscriptions, or otherwise use the Service. Prime Photo is strictly for adults. Uploading photos of minors is strictly prohibited, and minors may not be used with, depicted in, or be the subject of any content submitted to or generated by the Service under any circumstances.

Permitted and Prohibited Uses

You may only upload photographs of yourself. Do not upload photos of other people, children, public figures, celebrities, private individuals, or anyone who has not personally authorized that use. Do not use Prime Photo to impersonate another person, create misleading identity content, or generate intimate, sexual, exploitative, or non-consensual imagery.

You may not use Prime Photo to create, upload, or share content that is unlawful, abusive, hateful, harassing, sexually explicit, exploitative, deceptive, defamatory, infringing, invasive of another person’s privacy or publicity rights, or otherwise violates applicable law, third-party rights, these terms, AI provider rules, or app store rules. Unauthorized access to the Service, scraping, abuse, circumvention of safeguards, or reverse engineering is prohibited.

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

AI-Generated Images

Generated images may be imperfect, inaccurate, delayed, unavailable, or unsuitable for a particular purpose. You are responsible for reviewing outputs before saving, using, or sharing them. Prime Photo does not guarantee that generated images will meet your expectations, preserve every personal attribute, or be available at all times.

Intellectual Property

Prime Photo owns all platform content, software, designs, templates, and materials made available through the Service, excluding the photos you upload. You retain the right to use the images you generate for personal purposes, including on social media and dating platforms, subject to these terms. You may not use Prime Photo’s name, branding, or materials without permission.

In the event of any third-party claim that the app or your possession and use of the app infringes that third party’s intellectual property rights, Prime Photo, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Data Handling and Processing

By uploading images or other data to Prime Photo, you consent to their processing for the purpose of generating AI content. Uploaded face images are not used to identify or profile individuals. Aggregated, anonymized data may be used to maintain and improve the Service. Your use of Prime Photo is also subject to the privacy choices described in the Privacy Policy.

Public Content and Private Outputs

Prime Photo does not automatically publish user-uploaded photos or generated images. The public Explore feed is first-party curated by the Prime Photo team and is not created from user submissions unless we separately obtain the rights and permissions needed to use content publicly.

Generated Content Responsibility

Prime Photo is not responsible for misuse of generated content, including impersonation, deception, or violations of third-party rights. You are solely responsible for how you use, share, or distribute the images you generate.

Prime Photo, and not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of the app, including but not limited to product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.

Reports and Safety Review

You can report generated outputs from inside the app or contact us at [email protected]. We may review reports, remove or restrict content, preserve evidence, suspend or terminate access, deny generation requests, or take other action when we believe content or behavior violates these terms, AI provider rules, app store rules, or applicable law.

Subscriptions and Purchases

Paid digital features, subscriptions, credits or limits, and purchase restoration are handled through Apple in-app purchase or other app store purchase systems where required. Apple processes these purchases; Prime Photo does not collect or store your payment card details. Subscription terms, pricing, renewal, cancellation, trial details, and refund options are shown before purchase and are managed through your app store account. Prime Photo does not process external payments for iOS digital features outside the purchase systems required by Apple.

Accounts and Devices

Prime Photo may use Apple sign-in or app account identifiers to authenticate access and connect purchases, profile-photo references, generation limits, and notification settings to your device or account. You are responsible for maintaining the security of your account and device. Notify us if you believe your account or content has been accessed without authorization.

Security

Prime Photo maintains reasonable administrative, technical, and organizational measures to protect uploaded content. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Analytics and Advertising Measurement

Prime Photo may use analytics and advertising measurement tools, including Meta App Events and Meta Aggregated Event Measurement, to understand product usage, measure subscriptions or purchases, attribute campaign performance, prevent fraud, and improve the Service. Your use of Prime Photo is also subject to the privacy choices described in the Privacy Policy, including iOS App Tracking Transparency settings and the limits of aggregated ad measurement.

Third-Party Integrations

Prime Photo may link to or integrate with third-party platforms and services. We are not responsible for the content, privacy practices, or security of those external platforms. You must comply with any applicable third-party terms of agreement when using the app, and your use of any third-party service is governed by that service’s own terms and policies.

Account Enforcement

Prime Photo may suspend or terminate accounts that violate these terms or misuse the Service, with or without notice. You may stop using the Service at any time.

Service Changes

We may update, suspend, or discontinue parts of Prime Photo at any time. We may also update these terms when the Service changes or when required by law.

Disclaimers and Liability

Prime Photo is provided on an as-is and as-available basis, without warranties of any kind. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Prime Photo is solely responsible for providing any maintenance and support services for the app, and Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app. Prime Photo is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Prime Photo’s sole responsibility.

Changes to These Terms

We may revise these terms from time to time. When we do, we will update the date above. Your continued use of the Service after changes take effect constitutes your acceptance of the revised terms.
